Role in Criminal Procedure of US Constitution - Essay Example In the US Constitution itself, there is an Article that includes provision for both pre-trial and trial rights. Article III, Section. 2, Clause 3 indicates that ââ¬Å"[t]he Trial of all Crimes [â⬠¦] shall be by Jury; and such Trial shall be held in the State where the said Crimes shall have been committed [â⬠¦]â⬠(National Archives, ââ¬Å"Constitution of the United States, Art.III, à §.2, cl.3â⬠, 1787) This passage determines two important elements of criminal procedure, namely the jury and venue. These are crucial while they describe the place and method of criminal procedure.As for the Bill of Rights, there are several Amendments that are relevant to the current research question. To be more specific, Amendments Fifth, Sixth and Eight seem to be the most important to determining criminal procedure. Within the Fifth Amendment, there are several crucial points to understand in regard to criminal procedure. First, this Amendment rejects punishment for capital or i nfamous crimes except for specific cases. Similarly, in the Eight Amendment, it is stated that ââ¬Å"[e]xcessive bail shall not be requiredâ⬠, nor ââ¬Å"excessive fines, nor cruel and unusual punishments.â⬠(National Archive, ââ¬Å"Bill of Rights, Amendment VIIIâ⬠, 1789) Second, Amendment V also indicates that one person will not be answering twice for the same crime. Third, any person has the right not to witness against oneself. Finally, the Amendment does not allow the punishment of a person without due juridical process. This has something to do with the situations that happened in the past that involved the peace and order of the region. At present, the interest of most people is based on how the countries in the Middle East will deal with the present global financial crisis. News from this region mostly pertains to this issue as well as other events that are related with its peace and security. This weekââ¬â¢s news gave emphasis on the situation of the Arab World when it comes to their financial stability especially with the looming crisis in their midst. According to recent updates, Arab markets continue to deteriorate. The regionââ¬â¢s decreasing economic robustness is observable in its stock market that has been decreasing for four straight days. Tadawul All of Saudi Arabia, which is recognized as the largest stock holder in the Middle East, experienced a decreased of more than 7. 5 per sent of their shares. In the same manner, other Arab countries like the shares of Dubai lost more than 25 per cent of their trading value and even the Kuwait stock exchange, the second largest in the region decreased by 2. 8 per cent. These clearly show that the Arab World is also greatly affected by the financial crisis in the world today (Aljazeerah, 2008). There are also observable security threats in some countries in the region. This is greatly evident in Iraq when a bomb exploded at the Abu Dshir market. The bomb exploded a vehicle that killed 13 people and inflict injury to another 27. Even though there are still violent incidents in the country, police reported there is a steady decline in this kind of incidents. The latest notable attack was when the MP Moqtada Sadr from the Shia was killed by using a roadside bomb (BBC, 2008). On a lighter note, good things are also happening for some countries in the Arab World. One of which is the exclusion of Jordan from Egyptââ¬â¢s rice embargo. Egyptian Minister of International Cooperation Fayza Abul Naja explicitly announced that Egypt is willing to provide Jordanââ¬â¢s rice needs. This transaction does not only stand for economic partnership for these two countries but it also symbolizes their strengthening relationship. The Arab World like any other region in the globe is also facing numerous challenges (The Jordan Times, 2008). These problems occur in different areas of concern in the region. In all the different places I have worked there has always been a dress policy. In the Army we wore BDUââ¬â¢S and I always had to have my hair up. When I started working as a CNA again I had to ware a uniform ââ¬Å"Scrubsâ⬠and there again they liked are hair to be up. I think in every job setting there should be a dress code for one it will distinguish you from everyone else and it lets the employees respect their job. Language had never been a real big problem to have to censor in the jobs that I have had. I think as an adult working in a professional setting you know what to say when you can say and where you can say it. Casual dress, a workplace perk acceptable throughout corporate America, is not altogether as common in other parts of the world. . (Tatiana D. One should not confuse the distinction between the presence and absence of conflict with the difference between competition and co-operation. In competitive situations, the two or more parties each have mutually inconsistent goals, so that when either party tries to reach their goal it will undermine the attempts of the other to reach theirs. Therefore, competitive situations will by their nature cause conflict. However, conflict can also occur in cooperative situations, in which two or more parties have consistent goals, because the manner in which one party tries to reach their goal can still undermine the other's attempt.

While the rest of the hard rock bands wanted to get rich and a lot of women, Metallica, as in the words of former lead guitarist Dave Mustaine, ââ¬Å"Our hole existence pretty much was guitar, dominating the world and getting liquored upâ⬠. à à à à à During the late 1970s and early 1980s, there was a new wave a British Heavy Metal entering the cassette and 8-track decks of people everywhere. Over in Denmark, current Metallica drummer Lars Ulrich, was a hug fan of this type of music. So obsessed with this music, Lars Ulrich wanted to start a heavy metal band... a band that he could play his favorite songs with. à à à à à On the other side of the globe, James Hetfield, Metallicaââ¬â¢s current rhythm guitarist and lead singer, was looking to start a band of his own. His current roommate had taught him how to play guitar and James was very motivated to get something started. In effect, James had put a listing in a worldwide music magazine, The Recycler under ââ¬Å"Hâ⬠for ââ¬Å"Heavy Metalâ⬠. James and Lars, were the only ones listed, so it was obvious that the two should talk to each other. à à à à à In the fall of 1981, the band ââ¬Å"Metallicaâ⬠was formed. Playing drums was Lars Ulrich, on bass guitar was Ron McGoveny, playing lead guitar was Dave Mustaine, and rhythm guitar and lead vocalist was James Hetfield. During the song writing process over the next few months, the band became very addicted to Alcohol. When drunk, Dave Mustaine would get very violent, while the rest of the band would get happy. Happy and Violent people just donââ¬â¢t mix. Ron McGoveny could not handle the situation with Dave, and so he left the band. à à à à à Lars, James, and Dave then went around to local clubs to check out bassistsââ¬â¢ from other bands. At one club, they found Cliff Burton playing with a band called Trauma. Cliff Burton was a technical engineer and could do certain things on a bass that would make it sound like noises from a guitar. After the show that night, Lars, James, and Dave confronted Cliff asking him to join ââ¬Å"Metallicaâ⬠. Cliff said he would join, only if the band relocated from Los Angeles to San Francisco. à à à à à In Los Angeles, Metallica recorded their first demo... ...the Page,â⬠written by Bob Segar, was placed on this album. James Hetfield states, ââ¬Å"When I first heard this song, the lyrics spoke to me and I realized that this song was written for me, written for Metallica.â⬠The Video released for this song showed a story of a prostitute trying to support and provide a normal life for herself and her daughter, accompanied by the song in the back-ground. à à à à à Since the start of Metallica, the members have always been about the fans, and for the fans. The members of Metallica consider themselves to be four lucky fans who got together in a garage. Metallicaââ¬â¢s music goes much more deeper in emotions than rap and other new forms of ââ¬Å"popularâ⬠music. Since the day I started listening to Metallica, there hasnââ¬â¢t been a day that went by where I didnââ¬â¢t listen to them. Metallica has a song for every person and every emotion. By cutting there hair, by changing what ways they allow their music to be produced, they have grown up. Metallica was started by 17 year olds and while they are in their ripe, current age 37, they will continue making music that suits them, and only them. For that reason, they have my full and undivided respect.

This term we have studied the film bend it like beck ham and the novel looking for librarian. They both explore coming of age through different experiences to mature into the person they are today. But during that process they come across similar challenges to face. Jess is from a strict Indian silks family who expectations are high for both Jess and her sister pinky. The director of bend it like Bà ©chamel explores the experiences of coming of age by showing challenges with her culture.Jess wants to play football professional but her family and culture disapproves of this idea and has to go by her parent's values. The point of view shoot from basis's perspective and the quotation â⬠you can become a fine doctor and solicitor now â⬠this show the expectations and values of the family and culture. Josephine goes through similar challenges where she struggles to accept her culture and not hate it. Josephine says, â⬠I hate being Italian â⬠this shows Josephine not liking her culture and her background. BothJosephine and Jess go through similar challenges with their culture and learning to cope with it. Throughout the film and the novel Josses and Jess have to go through challenges with their family, Josses has grown up her whole life without a dad. When her dad shows up Josses is shocked and doesn't want to see him. ââ¬Å"We don't need himâ⬠, Josses says to her mum ,telling her she doesn't want him in her life. Through out the novel Josses has to overcome her hate she had for her dad in the past and let it go. And allow accepting him in her life.Jess might not have a new dad in her life but she sure does have family issues. Jess finds out her finals is on the same day as her sisters wedding. She has to choose between her futures of her family. She chooses family because she knows it's the right thing to do â⬠IM not lying any moreâ⬠Jess says realizing . Lying is not right and has to become more mature and choose right decisio ns. As the wedding goes on her dad saw she was upset and allowed her to go to the rest of the game on a conditions she comes back straight after.The parallel hot of pinky held up by Teeth and Jess been help up by her team and Josses learning to accept her dad represents that both girls have achieved a new mile stone in the coming of age experience. By going through the experience of coming through age Josses and Jess also go through different challenges. Jess has gender restrictions where her culture and family do not believe a girl should play football Jess ignores her culture and lies to her parent's . When her parent's find out and forbids her to play again Jess stands up to her family telling them this is my passion and what I love to do. F I can't tell you what I want now, then I will never be happy' Jess sticks up in what she wants in life even if her culture and family do not agree. Josses also goes through a harsh time when her close friend died I wonder now why I thought it John's suicide] wasn't true. Paper and could forget the next day. â⬠This shows Josses trying to accept John has died and is never coming back. Both Josses and Jess have similar challenges to allow them to come of age thought out the novel and film but despite there similarities they also have differences as well.

Rip the Character I always thought the story of ââ¬Å"Rip Van Winkleâ⬠was a kidââ¬â¢s story teaching the lesson to not be lazy. While in a way it still is a story about not being lazy it also symbolizes so much more than I ever knew. The character of Rip is used to show how the American man is seen from abroad. The foreigners stereotyped the typical American male as being the perfectly jolly over grown child, perpetually ââ¬Å"one of the boysâ⬠, and ignorant of his own wife and the whole world of other adult men. Throughout out the following short essay I will discuss and support my topic of Rip as symbolic of the mythic American male. For example in the very beginning of the story Rip is perceived as a very lazy, yet jolly young man. When heââ¬â¢s introduced he is ducking out of work and avoiding the wife. All Rip wants to do is sit back and relax and let all the good things come to him. Rip himself does just enough to provide for him and his family. Speaking of his family, Ripââ¬â¢s children were very wild and ragged looking. Even his own son was taking after him all the way from his clothes to his attitude towards things. It is said in the story that Rip, if left to himself, would of whistled life away in perfect contentment. Such examples in the story point to how ignorant Rip is of his family and the rest of the world. Rip tried to work, but everything he tried don his own farm was useless. Every part of his farm was horrible. All his fences were falling apart, which sent his cows astray. Weeds had taken over his cabbage patch. Ripââ¬â¢s farm had become the worst farm in the town. No matter what Rip did his farm just wouldnââ¬â¢t do the correct thing. So instead of trying to fight his own farm Rip would take his jolly self into town every day.
